Please note that this has not been updated since it was published. Deprivation of Liberty Safeguards (DoLS) remain in place until October 2020 when they will transfer to the Liberty Protection Safeguards under the Mental Capacity Act (Amendment) Act 2019.

Councils have to ensure that people who are unable to make their own decisions about where they live are safeguarded from having their liberty restricted. It is essential that the public, families and carers understand what these safeguards are.

This updated Brief Guide, presented in an Easy Read format, provides a jargon-free introduction to the Deprivation of Liberty Safeguards (DoLS), explains how they work and sets out what to expect. It also takes into account the Supreme Court ruling in 2014 that further clarified the legal definition of being ‘deprived of liberty’.
