House of Commons Deprivation of Liberty Safeguards Briefing

Image: The House of CommonsThe House of Commons has released a Deprivation of Liberty Safeguards (DoLS) briefing document following The Law Commission's recommendation to replace DoLS with a new scheme called the Liberty Protection Safeguards:

‘The Law Commission recommends that DoLS are repealed as a matter of urgency, and are replaced by a new scheme called the Liberty Protection Safeguards. The new safeguards would streamline the process for assessing whether a deprivation of liberty is necessary, and obtaining the required authorisation.’

The briefing gives a history of the Deprivation of Liberty Safeguards, outlines the current authorisation and assessment process, and gives an overview of the recent and proposed changes.
